Regalty Estates manage many developments at differing stages of life, from new builds to developments first built in the 1819.  Each site poses different problems and solutions. Below are some case studies we’ve encountered and how through bespoke solutions and at times tough decisions and we’ve been able to put things right.

Low service charges / Poor ongoing investment in a building.
After historical financial mismanagement, the company had little in the way of a sinking fund. Continued low service charges that were badly spent which meant the building had suffered a high degree of dilapidation and decreased value.
 
Regalty Estates often encounters developments that have been financially mismanaged, usually leaving buildings in a poor state of repair and without ‘sinking funds’ for future maintenance or emergencies. In this case Regalty Estates worked hard to calculate a service charge budget that takes into account the age and future maintenance needs of the estate. After several years of investment, properly consulted, the management company now have a healthy sinking fund and an ongoing refurbishment plan.
 
Developer disputes over Major Defects
Developers are always quick to finish one development and move onto the next.
A client discovered that there were problems with the building after the developer stated that the building had been ‘completed’. The developer did not accept responsibility. 
 
Regalty Estates work with residents as well as developers; we understand how a building should be ‘handed over’ and what latent defect are. On this occasion we worked hard with the Chairman of a management company and his board to pursue the developer and Insurer to enforce the rights of leaseholders to have the project properly finished.
 
Insurance Company’s Refusal to Pay

A management company had suffered major losses in excess of £60k due to an insurance company refusing to settle a claim. 
 
Over the last 10 years Regalty Estates has acquired an in-depth knowledge of insurance relating to buildings cover. We knew the decision was incorrect and our legal team represented our client through the court system. The decision was overturned and we obtained full damages against the insurer.
 
Leasehold Tribunal Representation

A resident challenged the rights of a clients management board to raise a levy and enforce it within the confines of the Landlord & Tenant Act. The issue was pursued to a full tribunal hearing.

There are times when not all residents agree with decisions made relating to their homes. Regalty Estates always listens and try to understand the point of views from all residents but sometimes it goes beyond resolution. In this instance we represented our client at the Leasehold Tribunal, winning our case along with costs.
